INTRODUCTION
ABACUS GmbH ("WyldSociety", the "Company", "we", and "us") is committed to maintaining a secure and trustworthy private community, and we understand that privacy and confidentiality are of utmost importance to our members, applicants, participants, and other users ("you"). Your privacy is our top priority in everything we do and in every function we develop. This Privacy Policy (the "Privacy Policy") reflects our commitment to protecting your privacy and describes the information we collect, how that information may be used, and with whom it may be shared. We have tried to describe the policy in clear language, avoiding legal and technical jargon as much as possible. By using our application (the "App"), certain features of it, or related services, including but not limited to those associated with signing up for and/or attending events promoted, featured, hosted, or otherwise disseminated through the App (collectively the "Service"), you agree to the terms described herein. This Privacy Policy applies to your entire use of the Service. We encourage you to read this Privacy Policy and our Terms and Conditions carefully and contact us with any questions at info@wyldsociety.io.
We will update this Privacy Policy from time to time to reflect changes in the law, our data processing practices, the features of our Service, or technological advances. If we make changes, we will change the "Updated" date at the top of this Privacy Policy, which will be posted at https://www.wyldsociety.io/privacypolicy . We recommend that you regularly check for the latest version, as your continued use of the Service after changes to this Privacy Policy are posted signifies your acceptance of and agreement to the same. If you do not agree to such changes, you can delete your account at any time in accordance with our Terms and Conditions.
COLLECTION OF INFORMATION
Information You Provide in Connection with Membership.
To apply for membership in the App, you will be asked to begin an application with certain login information such as your Instagram handle, contact information, and phone contacts, among other things. By submitting the application, you authorize us to collect information from your Instagram account, such as your username, profile picture, follower list, the list of people you follow, and the number of images. This information is used to verify your identity and evaluate your real-world connections with our existing members. Additionally, we may collect and store any personal data you provide in connection with your application or during your use of our Service, including but not limited to identifying information such as your name, Instagram handle, email address, date of birth, gender, hometown, place of residence, phone number. In connection with your use of the Service, you may also provide us with content such as photos. All information you provide may be accessed by venues (our customers) of the Service. If you express interest in a venue or attend an event, you provide us with this information. Should you contact us with a request, we may collect the content of that correspondence or interaction. You can change personal information (name, gender, ethnicity, photos, phone number) at any time within the App settings.
Information Provided by Other Users.
In addition to the information you provide to us, other users may provide information about you when they use the Service, for example, if they contact us about you or you are a contact in their phone.
Automatically Collected Information.
In addition to the information you provide, certain information is automatically collected while you use the Service, including but not limited to your device's operating system, your device type and device ID, your IP address, how and how often you interact with other users, and your access times. If you grant us permission to use location services, we will automatically collect data about your geographic location at any time or while the App is active, depending on the permission granted. Note that even if you do not grant us permission to use location services, we may collect data about your city, state, and general location (not your exact location) via your IP address.
Third-Party Websites.
If you access a third-party website through our in-app browser, such third-party websites may independently request and collect information from you. You should consult the privacy policies available on these websites, as their policies are beyond our control.
Financial Information.
Since we only accept payments through third-party services such as Apple and Stripe, we will never ask for your credit card information, and your financial data will be protected by and remain subject to the applicable security and privacy policies of the third party.
Cookies and Other Similar Data Collection Technologies.
We may use cookies and similar technologies to recognize you and/or your device. This may be used, among other things, for authentication, storing your settings, analyzing usage trends, and enabling access to certain features of the App. Some devices and web browsers have a "Do Not Track" ("DNT") feature that signals that a user does not wish to be tracked. As not all devices and browsers offer a DNT option and DNT signals are not yet uniform, WyldSociety, like many companies, does not currently respond to DNT signals.
Data Controller Information.
The Company is responsible for maintaining and protecting your information in accordance with this Privacy Policy. The Company can be reached at info@wyldsociety.io and will promptly respond to any inquiries regarding your data.
Sharing and Use of Information
The personal data you provide will only be used in connection with the Service. We will never sell your personal data to third parties and will not share your personal data with third parties without your permission; however, we use information internally and with selected third-party analytics services to improve and operate the Service, as described below.
Information Shared with Other Users.
When you register as a user of the Service, your App profile will be visible to other users of the Service. These other users can see information you have provided to us directly or through Instagram, such as your Instagram username, uploaded photos, first name, age, city of residence, hometown, biography.
Use of Posted Material by Venues.
By attending WyldSociety events and posting content related to these events on Instagram, other social media, or the internet, you grant the respective venue the right to use this content for marketing and promotional purposes. This includes but is not limited to the use of photos, videos, comments, reviews, and other materials created or posted during or after, or in connection with the visit. Venues may use this content across various media and platforms without additional consent or compensation. WyldSociety is also entitled to use posted material for its advertising purposes or social media, etc.
Use of Information by WyldSociety.
We may use information we collect about you for, among other things,
(i) creating and managing your account,
(ii) managing events, RSVP lists, and operating and improving the event service,
(iii) providing and improving the Service, including developing new features,
(iv) facilitating and monitoring the use, content, and interactions between users,
(v) conducting internal or third-party research, analysis, and analytics through services such as Google Analytics,
(vi) managing our business,
(vii) communicating with you, and
(viii) enforcing or exercising rights under our Terms and Conditions.
Information we share with Google Analytics is subject to Google's privacy policies.
Service Providers; Advertising Partners.
We may share non-personal, non-identifiable information with third parties who provide services on our behalf or provide advertising benefits to you as a WyldSociety member. These service providers and advertising partners may have access to such non-personal, non-identifiable information as necessary to perform their functions, but they may not share or use the information for other purposes.
Other Situations.
We may disclose your information in connection with
(i) certain legal matters and ensuring compliance with legal requirements,
(ii) a subpoena or similar investigative request, court order, or a request for cooperation from a law enforcement or other government agency,
(iii) a significant business transaction, such as the sale of our business or its assets, or
(iv) your consent or request.
Aggregated and Non-Personal Information.
In addition to the uses of your personal data described above, we may use and share non-personal, non-identifiable information we collect through your use of the Service. We may also use and share aggregated, non-personal information with third parties, including advisors, investors, and professionals, for purposes related to our business.
Legal Bases for Processing Your Information.
We rely on the following legal bases for processing your information:
(i) In most cases, we process your information to fulfill the contract you have entered into with us. For example, if you use our Service to facilitate meaningful collaborations, we use your information to maintain your account and profile, make it visible to other users, and recommend other users to you;
(ii) We may also use your information when we have a legitimate interest (for example, we analyze user behavior to improve the Service and develop new features, and we process information for administrative, fraud detection, and other legal purposes); and
(iii) Finally, from time to time, we may ask for your consent to use your information for specific reasons. You may withdraw your consent at any time by contacting us at info@wyldsociety.io.
SECURING YOUR INFORMATION
Cross-Border Data Transfers.
Sharing the information mentioned above sometimes involves cross-border data transfers, such as to the United States and other jurisdictions. For example, the personal data of users in the European Economic Area ("EEA") is transferred to countries outside the EEA. We take all reasonable steps to ensure that personal data remains protected. For example, we use European Commission-approved standard contractual clauses or other appropriate safeguards to facilitate data transfers from the EEA to other countries. Standard contractual clauses are commitments between companies that transfer personal data and require them to protect the privacy and security of your data. Security Measures; No Liability.
We take the security of your information very seriously and have implemented a range of measures to protect it. Despite our efforts, no system is entirely secure. While we have taken and will continue to take reasonable steps to update and improve our security regularly, including regularly monitoring our systems for potential vulnerabilities and attacks and reviewing our information collection practices, we cannot guarantee that your information or other communications will always be secure. We are not liable for any loss, misuse, or alteration of your personal data. Users outside Germany should note that your information may be stored on our servers located within or outside Germany. By using the Service, you consent to the transfer of your information to countries that may not provide the same level of protection as your country of residence. If you believe that your account or information is no longer secure or otherwise have information relevant to us regarding information security, please notify us immediately at info@wyldsociety.io.
Storing Your Information.
We retain your personal data only for as long as we need it for legitimate business purposes and as permitted by applicable law. To ensure the safety and security of our users on and off the Service, we implement a safety retention window of three months following account deletion. During this period, account information is retained, though the account will not be visible in the App. In practice, we delete or anonymize your information after your account deletion (following the safety retention window) or after two years of continuous inactivity unless
(i) we need to retain it to comply with applicable law;
(ii) there is an outstanding issue, claim, or dispute requiring us to retain the relevant information until it is resolved; or
(iii) the information must be retained for our legitimate business interests, such as fraud prevention and enhancing user safety.
Note that even if our systems are designed to carry out data deletion processes according to the guidelines above, we cannot guarantee that all data will be deleted within a specific timeframe due to technical limitations.
TEXT MESSAGES AND OTHER COMMUNICATIONS
By using the Service in any capacity, including signing up for an event or otherwise using our event service, you agree to receive text messages and other correspondences from us regarding event updates, upcoming events, features, and other promotional activities. These messages and other correspondences may be based on the information you provide and other data we collect based on your use of the Service.
YOUR RIGHTS
Tools to Control Your Information.
We want you to have control over your information, so we have provided you with the following tools:
(i) Account settings to help you access, correct, or delete information you have provided to us that is associated with your account, directly within the Service;
(ii) Permission systems for mobile devices for certain types of device data and notifications, such as phone book and location services, and push notifications, which you can change in your device settings to either agree to or decline the collection of the relevant information or display the relevant notifications; and
(iii) You can delete your account at any time by using the appropriate functionality directly within the Service. You may also withdraw consent to the use of your personal data at any time at your discretion. We want you to be aware of your privacy rights. You should remember that you have the following rights concerning your information:

UNINSTALLATION AND RESPONSIBILITY
Remember that you can stop the collection of information at any time by uninstalling the App using your device's standard uninstall procedure. If you uninstall the App from your mobile device, the unique identifier associated with your device will continue to be stored. If you reinstall the application on the same mobile device, we may link this identifier with your previous transactions and activities. In certain countries, including those in the European Union, you have the right to file a complaint with the relevant data protection authority if you have concerns about the processing of your personal data. The data protection authority where you can file a complaint may be, in particular, that of your habitual residence, your place of work, or the location where we are established.
AGE RESTRICTION
You must be at least 18 years old to use the Service. However, we are not liable if an applicant misrepresents their age. If we become aware of a user under 18 years of age, we will immediately remove that user from our Service. We do not knowingly collect, store, or use information from children under 18.
NO THIRD-PARTY RIGHTS
This Privacy Policy does not create enforceable rights for third parties and does not require the disclosure of information about users of the Service.
ABOUT US
Your access to the Service and this Privacy Policy are governed by the laws of the Federal Republic of Germany. By using the Service, you agree to the exclusive jurisdiction of the courts in Germany. You agree that these courts have personal jurisdiction and venue and waive objections based on improper venue. You agree not to file or participate in any class action lawsuit against us.
